Our Ref: RS/STA/x22-0733
Dear Michael Barnacle,
Application for Charitable Status – Fossoway Community Development Trust Limited SC052550
I am pleased to tell you that the Office of the Scottish Charity Regulator (OSCR) is satisfied that your organisation meets the charity test, and has entered it in the Scottish Charity Register. This means it now has charitable status under the Charities and Trustee Investment (Scotland) Act 2005.
The charity will appear on the external Charity Register within 24 hours. You can access the entry using the Charity Register Search, entering the charity number SC052550 (SC zero).
The register entry can be printed by selecting ‘Print this page’ at the top right of the entry. The register entry is legal proof of charity status and this document may be used to demonstrate this to other regulators, banks, HMRC etc.
Charity trustees’ duties and responsibilities
The charity trustees are jointly responsible for running the charity and managing its assets. The charity trustees must also do the following:
- Publicise your organisation’s charitable status and provide information to the public: you must let people know that your organisation is a charity by including its charity name and charity number on its literature, emails and web pages (where applicable), and also on documents issued by a third party on the charity’s behalf. You have six months from the date of this letter to comply with the duty to publicise the charity’s status. You must also supply a copy of your accounts and constitution to anyone who asks for them. You can find full details of these duties in our guidance and good practice for charity trustees which can be viewed at the following link on our website: https://www.oscr.org.uk/guidance-and-forms/guidance-and-good-practice-for-charity-trustees/.
- Annual monitoring: every year, you must provide information to us about the activities of your charity. Your charity must fill in an Online Annual Return and send this to us along with its accounts. You can find out more about preparing your accounts and reporting to us at the following link on our website: https://www.oscr.org.uk/managing-a-charity/charity-accounting/. Please check your accounting reference date in OSCR Online. The accounting period can be between 6 to 18 months and you can amend this when logged into OSCR Online. Some registered companies chose to change the reporting period to coincide with their account submission to Companies House.
- Making changes to the charity: you need to get our consent before taking certain actions, and must tell us about certain decisions you have taken. You can find out when and how to do this at the following link on our website: https://www.oscr.org.uk/managing-a-charity/making-changes-and-reorganising/making-changes-to-your-charity/making-changes-to-your-charity/
